Every platform connected to your channel leads to the same InstiBot account. The owner is responsible for what team members do in the dashboard. Team members must follow these terms as well.","Overlay URLs, player URLs and Stream Deck action links contain secret tokens. Treat them like passwords: anyone who has one can use it. If one leaks, regenerate or delete it from the dashboard."]},{"title":"Permissions you give us on Kick and other platforms","body":["When you connect Kick or Twitch, you allow InstiBot to read and act on your channel within the permissions shown on that platform's authorization screen, for example reading chat and events, sending messages, moderating chat, managing channel point rewards, changing the title or category and creating clips, but only as your settings tell it to.","When you connect YouTube, you allow InstiBot to manage your YouTube account through YouTube API Services: to find your live broadcast, read its live chat and post, delete and moderate messages there, only as your settings tell it to. By connecting YouTube you agree to the YouTube Terms of Service (https://www.youtube.com/t/terms), and Google's Privacy Policy (https://policies.google.com/privacy) applies.","TikTok is read-only. Sign in with TikTok uses TikTok's official Login Kit only to identify you. Reading a TikTok LIVE uses an unofficial connector that TikTok does not provide, endorse or support, so it may stop working or be limited at any time. Connect only a TikTok account you own or are allowed to manage, and make sure that using InstiBot with it complies with TikTok's terms.","If you use a custom bot name, through a second Kick account or through your own Kick app, you allow us to send messages with that identity. You are responsible for that account or app and for following Kick's developer and platform rules for it. We store its credentials encrypted and delete them when you disconnect it or as described in the Privacy Policy.","You can revoke our access at any time on Kick, Twitch, Google (https://myaccount.google.com/permissions), TikTok, Discord or the other platform. Features that depend on that access will stop working."]},{"title":"Your content and your channel","body":["\"Your content\" means everything you or your team add to InstiBot: commands, timers, messages, uploads such as images, sounds and videos, overlay settings, store items, sponsor details and similar material. You keep ownership of your content.","You give us a worldwide, non-exclusive, royalty-free licence to host, copy, process, adapt (for example resize or transcode), display and transmit your content only as needed to run, secure and improve InstiBot for you, including showing it on your public pages and in your overlays. The licence ends when you delete the content or your account, except for copies in backups until they rotate out and content that was already shown publicly.","You confirm that you own your content or have every right needed to use it this way, and that it does not infringe anyone's rights or break any law. This includes music, sounds and media played through alerts and song requests: licensing what plays on your stream is your responsibility.","You are responsible for everything the bot posts in your channel because of your settings, including custom commands, timers, alerts, sponsor messages, song requests and game messages. Do not use InstiBot to break the terms of service or community guidelines of Kick, Twitch, YouTube, TikTok or any other platform you use it on, or the law.","We do not review content before it is used, but we may remove or disable content, or limit features, if we reasonably believe it breaks these terms or the law, or after a valid complaint."]},{"title":"Our intellectual property","body":["InstiBot and everything we provide in it belong to Instinckt or its licensors. This includes the software and source code, the server and overlay code delivered to your browser or OBS, the designs, layouts, animations, graphics, overlay styles and themes, the dashboard's look and feel, the game logic and balancing, the setup packs, default commands, default messages and templates, documentation, texts and translations, the databases and compilations we build (including statistics and directory data), and the InstiBot name, logo and branding.","They are protected by copyright, trademark, trade secret, database and unfair competition laws, including the Israeli Copyright Act, 2007, the Israeli Commercial Torts Law, 1999, the Israeli Trademarks Ordinance, 1972, and the equivalent laws of other countries and international treaties.","We give you a personal, limited, non-exclusive, non-transferable and revocable licence to use InstiBot for your own streams, under these terms. Overlays and players may be shown only in your own broadcasts through InstiBot's own URLs. Nothing in these terms transfers any of our rights to you, and all rights not expressly granted are reserved."]},{"title":"What you may not do","body":["Copy, reproduce, modify, translate, sell, rent, sublicense, publish or create derivative works of any part of InstiBot, including its code, designs, overlays, texts, templates or layouts, except as these terms expressly allow.","Decompile, disassemble, reverse engineer or try to extract the source code, algorithms or structure of InstiBot, including by downloading, saving, re-hosting or analysing the code of the overlays and pages, except where the law does not allow this restriction.","Scrape, crawl, harvest or systematically collect data, content or texts from InstiBot by bots, scripts or any automated means, or use our undocumented interfaces. Ordinary search engine indexing of public pages is allowed.","Frame, mirror or embed InstiBot in another product, or remove or hide any notice of ownership, branding or attribution.","Access or use InstiBot to design, build, train, benchmark or improve a competing product or service, to copy its features, functions, user interface or texts, or to monitor its availability, performance or functionality for competitive purposes.","Abuse, overload, attack or probe the service, bypass rate limits, plan limits or security measures, or access accounts, channels or data that are not yours.","Use the bot to spam, harass, impersonate, deceive or defraud anyone, create fake accounts or fake referrals, or manipulate statistics, leaderboards, games or the shared ban list.","Use InstiBot in any way that breaks the law, the rights of others or the terms of Kick, Twitch, YouTube, TikTok, Discord, PayPal, Stripe or any other platform you use with it."]},{"title":"Independent development and other services","body":["InstiBot is developed independently by Instinckt. Chat bots and streaming tools share many common, functional and industry-standard features, such as chat commands, timers, variables, loyalty points, alerts, mini-games, song requests, moderation filters and dashboards with cards, tables and settings windows. These ideas and functional elements are not owned by any single provider, and similarity of such elements is not copying.","Names of other services, such as Kick, Twitch, YouTube, Google, TikTok, Discord, PayPal, Stripe, Nightbot, BotRix, StreamElements and Fossabot, are trademarks of their owners. We mention them only to describe compatibility and import options. InstiBot is not affiliated with, endorsed by or sponsored by any of them.","Import tools copy your own commands, timers and settings from another service only when you ask, using information that service makes publicly available or a file you provide. We do not ask for or store your credentials for other services. You confirm that you have the right to import the content and that doing so does not break terms that bind you.","If you send us ideas, suggestions or feedback, we may use them freely, without obligation or payment to you. We may also independently develop features or content that are similar to your ideas or content."]},{"title":"Loyalty points, games, bets and the store","body":["Points, levels, game winnings and bet results are virtual entertainment features. They have no monetary value, are not property, cannot be bought from us, and cannot be exchanged with us for money, goods or anything of value. We may reset or correct balances after errors, abuse or misuse.","Viewers earn points by watching and chatting and, if the streamer turns it on, as a thank-you for supporting the channel, for example with a subscription or membership, a gifted subscription, KICKs, Bits, TikTok gifts, a Super Chat or a tip. Points received this way are a free loyalty reward, not a purchase. Streamers must not present support as a way to buy points, and must not sell points or entries in any other way.","InstiBot does not offer gambling. If a game, bet, giveaway or store item offers a prize with money value, such as cash, gift cards, game items or physical goods, the streamer must make sure that taking part does not depend on paying, subscribing, tipping or spending points, and that subscribers and supporters get no better chance to win it. Streamers must not run any activity that is illegal gambling, a lottery or an unlicensed sweepstake where they or their viewers live.","Store items, rewards and giveaways are offered by the streamer, not by us. The streamer alone is responsible for fulfilling them, for their legality and for any taxes."]},{"title":"Tips, sponsors and channel point rewards","body":["Tips are paid through PayPal directly from the viewer to the streamer's PayPal account. Instinckt is not a party to the tip, is not a payment service, and never holds the money. Refunds, chargebacks, disputes, fees and taxes are between the tipper, the streamer and PayPal, under PayPal's terms.","Tip names and messages are written by the tipper and may be shown and read aloud on stream. Tippers must not use them to harass anyone or to break the law, and streamers can filter or remove them.","Sponsor and affiliate messages, links and banners are the streamer's own advertising. The streamer is responsible for the agreements with the brands and for clearly disclosing paid promotions as the law and the rules of the platforms they stream on require. Click counts are estimates and are not a basis for billing between you and a brand.","Channel point rewards on Kick and Twitch are features of those platforms. InstiBot can create and manage them and act on redemptions as you set it up; the points, rewards and refunds of redemptions follow that platform's rules. Bits, TikTok gifts and Super Chats are paid to the platform and handled under its terms; InstiBot only receives a notice of them."]},{"title":"Moderation tools and the shared ban list","body":["Moderation filters, raid protection and the shared ban list are automated aids. They may miss messages or act on messages that are fine. They act only within the settings you choose, and you remain responsible for moderation in your channel.","When you switch on the shared ban list, your channel contributes signals when an account is permanently banned or caught by raid protection, and can act on accounts that several other channels have flagged. Only the number of channels is shared, never which ones. Do not ban accounts in order to manipulate the list."]},{"title":"Free plan, Premium and billing","body":["The free plan and its limits may change over time. Premium is billed in advance, monthly or for the period you choose, through Stripe or PayPal, in the currency shown at checkout, and renews automatically at the end of each period until you cancel. Prices include or exclude taxes as shown at checkout.","You can cancel at any time from the billing page or by emailing bot@instinckt.co.il. We stop all future charges within 3 business days of your request, and Premium continues until the end of the period you already paid for.","If you are a consumer, you may also cancel a new purchase within 14 days, as the Israeli Consumer Protection Law, 1981 allows for distance sales. We then refund the payment within 14 days of your cancellation, minus a cancellation fee of 5% of the price or 100 ILS, whichever is lower, where the law allows that fee. Apart from that and other cases where the law requires a refund, payments are not refundable and unused periods are not credited. Nothing in these terms limits a cancellation or withdrawal right you have as a consumer under mandatory law, including the laws of the country where you live.","We may change prices for future periods. We will tell you in advance, and the new price applies only from your next renewal, so you can cancel before it does.","If a payment fails, is reversed or is charged back without good reason, we may downgrade or suspend the account. Premium grants from referrals, gifts or promotions have no cash value and cannot be transferred.","When Premium ends, data above the free limits is kept but switched off, and Premium-only features stop, as explained in the dashboard."]},{"title":"Referral program","body":["Referral points and the Premium months they unlock are a promotional benefit, not a payment. Referrals count only after review. We may reject or reverse referrals and grants that we reasonably believe involve fake, duplicate or related accounts, self-referrals or other abuse, and we may change or end the program going forward."]},{"title":"Third-party services","body":["InstiBot depends on services we do not control, including Kick, Twitch, YouTube and other Google services, TikTok, Discord, Spotify, PayPal, Stripe, Microsoft speech services, the Euler Stream signing service and our hosting providers. Song requests and the YouTube connection use YouTube API Services, so by using them you also agree to the YouTube Terms of Service (https://www.youtube.com/t/terms).","These services can change, limit or stop their interfaces at any time. When that happens we may have to change, limit or remove features, and we are not responsible for their actions, outages or decisions, including any action Kick or another platform takes on your account."]},{"title":"Changes to the service","body":["InstiBot keeps changing. We may add, change or remove features, limits and designs at any time. Features marked as beta or preview may be incomplete and may be removed. If we remove a significant Premium feature during a period you paid for, you may ask for a proportional refund for that period."]},{"title":"Confidentiality","body":["Non-public parts of InstiBot, such as unreleased or beta features, the dashboard's internal tools and anything we mark or describe as confidential, are confidential information of Instinckt. Do not disclose, copy or use them for any purpose other than using InstiBot as intended."]},{"title":"Suspension and termination","body":["You can stop using InstiBot at any time, disconnect it from Kick and the other platforms, and ask us to delete your account.","We may suspend or close your account, or limit features, if you break these terms, if the law or a platform requires it, if your use creates risk or possible legal exposure for us or others, or after a long period of inactivity. When reasonable we will warn you first; for serious or repeated breaches we may act immediately.","When an account is closed, your data is deleted as described in the Privacy Policy. The sections on intellectual property, restrictions, payments owed, disclaimers, liability, indemnity and law and disputes stay in force after termination."]},{"title":"Disclaimers","body":["InstiBot is provided \"as is\" and \"as available\". We may close the accounts of repeat infringers. Knowingly false notices may expose the sender to liability."]},{"title":"Enforcement and evidence","body":["We monitor the service for misuse and keep technical and security logs. We may use them, together with other lawful evidence, to investigate breaches of these terms and to protect our rights, including in legal proceedings.","Unauthorised copying or use of InstiBot causes us harm that money alone may not repair. In addition to any other remedy, we may seek an injunction or other urgent relief from a competent court, in Israel or anywhere else."]},{"title":"Law and disputes","body":["These terms are governed by the laws of the State of Israel, without regard to its conflict of law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.","The competent courts in Tel Aviv-Jaffa, Israel, have exclusive jurisdiction over any dispute relating to InstiBot or these terms, except that either side may ask any competent court for urgent relief.","If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may also bring a claim where the law gives you that right.","Before starting a legal claim, we ask that you contact us at bot@instinckt.co.il so we can try to solve the issue, ideally within 30 days. Some data is needed for a feature to work: without signing in with Kick, Twitch, YouTube or TikTok you cannot use the dashboard, and a streamer who does not enter a PayPal email cannot receive tips. Other data, such as your birthday, a linked Discord account or a tip message, is optional; if you do not give it, only that feature is unavailable."]},{"title":"Data from streamers and team members","body":["Account: the user id, username, display name and profile picture of each account you sign in with or connect (Kick, Twitch, YouTube or TikTok), your Kick channel id and name, and your email if Kick provides it. Your language, sign-in times, the IP address of your last sign-in, and the version of the Terms of Service you accepted and when.","Connections: access tokens for Kick and, if you use them, for a custom bot account or your own Kick app, including its client id and secret. These are encrypted at rest. If you connect Discord: your server and channel ids, the roles you choose and, if you link your own Discord account, your Discord user id and username.","Twitch, YouTube and TikTok: when you connect one of them we store its account or channel id, username, display name and profile picture, the permissions you granted, live status, stream title, category and viewer count, and, for Twitch and YouTube, access and refresh tokens, encrypted at rest. For YouTube we also store the id of the Google account that connected the channel, so that only that Google account can sign in with it, and the id of the running broadcast and its live chat. For TikTok we store the open id and username that TikTok's Login Kit gives us; we revoke the TikTok access token right after sign-in and never call TikTok with it. Disconnecting a platform in the dashboard deletes its tokens and connection data. You can also revoke InstiBot's access at https://myaccount.google.com/permissions (Google and YouTube), https://www.twitch.tv/settings/connections (Twitch), in TikTok's app settings (Security and permissions, Manage app permissions) and in your Kick account settings.","Google user data: we use the YouTube data we receive through Google APIs only to provide the features you see in the dashboard: identifying your channel and signing you in, finding your live broadcast, reading its live chat, Super Chats, Super Stickers and memberships, and posting replies, deleting messages and timing out or banning viewers as your settings tell the bot. We do not use it for advertising, do not sell it, do not use it to train AI models, and do not let anyone read it except with your permission, for security, or as the law requires. InstiBot's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy (https://developers.google.com/terms/api-services-user-data-policy), including the Limited Use requirements.","Settings and content: everything you configure or upload, such as commands, timers, alerts, overlays, media files, store items, sponsors and their links, setup choices, and the PayPal email address you enter for tips.","Billing: your plan, renewal dates, invoices and the customer and subscription references from Stripe or PayPal. Card and bank details are entered with Stripe or PayPal and never reach us.","Team: the Kick accounts you invite and the permissions you give them. Security: an audit log of changes made in the dashboard, with the account, time and IP address. Referrals: who invited whom and the sign-up IP address, used to detect fraud. Support: the messages you send us.","Spotify: if you connect Spotify for song requests, your Spotify user id, display name and subscription type (Premium or free), and access tokens, encrypted at rest. We use them only to read what is playing and to add, skip and control songs as your settings tell us. Disconnecting Spotify in the dashboard deletes this data."]},{"title":"Data about viewers","body":["When you chat in a channel that uses InstiBot, the platform you chat on (Kick, Twitch, YouTube or TikTok) sends or shows us your messages and events from that channel. We process your user id on that platform, username, display name, badges and role (such as subscriber, member, VIP or moderator) and your messages, in order to run the features the streamer switched on: commands, moderation, loyalty points, watch time, levels, games, bets, queues, song requests, the store, birthdays and alerts. On YouTube this includes the live chat of the streamer's broadcast with its Super Chats, Super Stickers and memberships. On TikTok we read the public chat, gifts, follows and subscriptions of the streamer's LIVE; InstiBot cannot post on TikTok.","We keep a list that links each Twitch, YouTube and TikTok account we see in chat to the internal id InstiBot uses for it, with its username, so that points, watch time and other results stay with the right viewer. Points and history are kept separately for each platform account you use.","We store the results of those features in that channel: points and their history, watch time, message counts, game and bet results, store redemptions, song requests, queue entries, and moderation actions together with the message that caused them. We do not keep a full archive of chat; most messages are processed in memory and dropped. Birthdays are an optional global setting linked to your Kick user ID. Saving one makes it available to channels where you have chatted in the last 30 days; a live greeting or overlay celebration happens only after you send a message in that channel while it is live and birthdays are enabled.
